Not sure if this is an eBike any longer. Might just be an eMoto now, and no place to ride it in Florida. China changes it's eBike standards.

I don't think it is governed, however, the top speed is controlled somewhat by the "Controller". For the Chinese market, the controller is set to 25 kph by law. For the export market, a 40 kph controller is installed. The speedometer will never read more than 25 kph by Chinese law regardless of actual speed or what controller is installed, much like the time period (79-82?) when new cars in the US would not display speeds over 85 mph, regardless of what engine they had or what speed they actually went over 85 mph. I say it is not governed because when you go downhill at full throttle, the speed well exceeds the controller speed, and the vehicle goes faster than simply coasting. I think the controller allows just enough juice to make it's rated speed on level ground.

Without pedals, in Florida, the Zoomer e: is currently not an e-Bike. As shown in the video, in China, it is an eBike, with or without pedals. Every country and pretty much every state or location has different definitions of what is an eBike. If this link is accurate, and if I read it right, California may call the Zoomer e: a motorized bicycle and you would be ok riding it:
